The United States of America

Canada
Cryptocurrencies are not considered legal tender in Canada. This was clearly expressed by the country’s Financial Consumer Agency (FCA). Canada, like the US, has yet to clearly define or legislate a framework surrounding cryptocurrencies. But Canada still appears to be among the most transparent of countries for the nation’s interpretation and enforcement of the law surrounding cryptocurrencies (aside from Switzerland). There are certain laws regarding transactions in virtual currency in the US today but there is still no comprehensive legal framework. The Commodity Futures Trading Commission currently regulates virtual currencies as commodities. The CFTC is the first US regulator to allow for public cryptocurrency trading. The Securities and Exchange Commission requires registration of any virtual currency traded in the US if it is classified as a security (e.g. by the Howey test).
The regulatory authorities have not yet formulated or offered a coherent framework for regulations regarding cryptocurrencies. Typical of most legislators and regulatory agencies in the US, the Securities and Exchange Commission (SEC) has intensified its focus on the pressing need for comprehensive regulation. And it seems everyone is waiting for the right catalyst to coalesce into a usable set of legal guidelines that can protect the investing public and also allow for blockchain and cryptocurrency innovation as well.
If cryptocurrency becomes a form of legal tender in the US, there will likely be stringent laws on its use. However, if cryptocurrency is treated like a security, cryptocurrencies would be regulated under securities law as interpreted by the SEC. Present securities laws place a large number of limitations on who is able to buy securities, how they are traded, and how to ensure transparency in the flow of information relevant to investors. Also note that non-US investors may experience their own difficulties getting a license to trade cryptocurrencies in the country. “ “Japan
Japan has always been one of the most positive and forward-thinking nations regarding cryptocurrencies and the blockchain. Of course, they were cautious at first, and they knew no more than anyone else in government, which means they literally knew nothing. But they took time to research, learn, and develop an approach to regulate the industry without killing it. The official policy is clear: Protect the public interest, but also encourage the growth of the industry with a legal framework that allows for innovation in blockchain and cryptocurrencies.
China
The situation in China is a sad one. The country has been taking increasingly strict actions to discourage and outlaw any activity related to the blockchain industry. China has banned ICOs, frozen all accounts associated with cryptocurrency, stopped bitcoin miners and even ordered a nationwide ban on all forms of cryptocurrency trading.
China has the strictest laws against cryptocurrency. Yet, despite that fact, as of 2017, 50% of the world’s mining population was from China! If you are involved with the cryptocurrency industry it is strongly advised to stay away from China, and avoid transactions with Chinese business because of the unpredictable and negative legal framework.

Brexit is scheduled to take place in March 2019, yet the UK and the EU still remain united in their regulatory attitude toward cryptocurrencies. There are also reports that the UK and EU are planning to end anonymity for cryptocurrency traders.
The UK and EU are both trying to control all the scams and frauds. They are working with cryptocurrency platforms to stop or at least report all suspicious transactions. This adds a degree of regulatory burden on the exchanges as well as increasing the associated compliance costs. Cryptocurrencies are extremely volatile. They are a high-risk investment. Governments across Europe are greatly concerned about the possibility of both retail and sophisticated investors losing a lot of money.
This has led to a situation similar to that in the US. The regulatory authorities have not yet formulated or offered a coherent framework for regulations regarding cryptocurrencies. There is an intense focus on the pressing need for comprehensive regulation. And everyone is waiting for the right catalyst to coalesce into a usable set of legal guidelines that can protect the investing public and allow for blockchain and cryptocurrency innovation as well. Exchange robberies and hacks like MtGox, and the recent loss of $530 million NEM coins have led to serious debate in the Japanese government. The industry needs to provide a secure and manageable solution to these problems. Voluntary self-regulation and close cooperation with regulatory authorities is the most favored solution. Based on the information received from the Columbia Science and Technology Law Review, there was a variety of responses from different government bodies about blockchain regulations. The regulators responses ranged from indifference to suspicion, and to positive expectation and excitement.
The US government has tremendous constitutional power to regulate business and industry, including of course the blockchain industry if it so desires. But basically, the federal government has been relatively indifferent and has even refused to speak on blockchain regulations despite the interest of various federal agencies. As of 2017, eight states in the US were working on bills promoting the use of cryptocurrency and blockchain technologies. It is even reported that a few states have actually begun the final steps before voting and passing legislation into law.
On April 3, 2018 Arizona introduced a law allowing corporations to hold and share data on the blockchain. The governor, Doug Ducey, put forward the legislation after the state began accepting signatures and smart contracts recorded on the blockchain as legally valid documentation. In 2017, Delaware was the first state to pass legislation allowing for shares of stocks to be legally traded on the blockchain.
Other notable developments have occurred in the US at the state or local level. Vermont makes use of blockchain as evidence in trials. Chicago uses blockchain to maintain real estate records. The entire European Union has approached blockchain with a positive and welcoming attitude. The EU has taken the position that they want to actively encourage innovation. This philosophy could support the development of cryptocurrencies in two ways:
-Encouraging the exploration of uses testing the impact and effect of the laws in a way that allows for a more finely-tuned and sophisticated understanding for all parties involved.
-Giving entrepreneurs the confidence that their target markets will be more trusting of their solution since they are operating with the explicit legal support of the state.
This approach, along with the EU’s scope as the regulator of 28 different countries, will encourage growth across the entire crypto ecosystem, and may end up transforming Europe into one of the most desirable destinations for blockchain development. Entrepreneurs are likely to move to the EU bloc to access the rich vein of available talent, as well as the positive and supportive laws.
The EU has actually disclosed through its executive arm that it is working on the use of blockchain for distributed ledger based projects. The UK has identified the inevitable need for a new payment solution and is gradually bracing itself for a widespread adoption of cryptocurrency in the future. There are even a few local pubs that accept BTC as a means of payment.
It is also interesting to note that the Bank of England has been closely monitoring bitcoin technology and has requested ideas from citizens on the improvement of its monetary system. Bitcoin is presently seen as “private money” where VAT is imposed from suppliers of goods and services that accept cryptocurrency as payment. Profits and losses incurred from cryptocurrency trading are also subject to capital gains tax, just as in the US.
In the UK, it has become increasingly clear that BTC can be part of a bigger story, and the trading volume indicates steady growth. The major banks in Australia have been quite hostile toward bitcoin, but at least the country has removed the burden of “double taxation” on cryptocurrency. This was good news to the local business community because blockchain startups had begun to leave the country as a direct result of unfavorable taxation and closure of bank accounts.
The use of BTC still remains unregulated, there is no law or regulation restricting the use of cryptocurrencies by Australian citizens. Cryptocurrencies are regarded as a form of property in Australia, and purchases with BTC, for example, are referred to as “barter”.
The Australian Securities Exchange (ASX), you will remember, is transitioning its CHESS verification system to a blockchain solution that should go live at the beginning of 2019. Singapore is another important regional hub in Asia for its strong rule of law as well as low taxation. The country offers one of the highest standards of living in the world. It is centrally located in the heart of Asia, so it easy to travel and recruit talent from surrounding countries. At the present there are not any specific regulations targeting the blockchain industry, but it is one of the world’s largest countries by funds raised for ICOs. It has a competitive tax regime in combination with strict AML and KYC. All of these factors make Singapore Asia’s leading location to launch and base an ICO.
The regulatory situation around the world may seem rather complicated. That is because it is. Laws and regulations are changing rapidly all over the world. And the regulatory framework is the most significant point of concern for a startup ICO. You should carefully study not only the current regulations surrounding your particular venture and how its tokenomics affects its classification, but you also need a reasonable sense of where the country is likely to be six months or a year later. Switzerland is trying to remain relevant for the blockchain industry and for ICOs. The Swiss finance ministry is actively trying to attract investors to the country. Switzerland is considered a very important crypto location due to fact it was home to four of the largest ICOs in the world. The country is also very attractive to investors because of its friendly regulations and digital expertise. The taxation and regulatory environment is extremely secure and positive towards the cryptocurrency and blockchain industry in general.

Rushing into Bitcoin?

Bitcoin is a great place right now, but it's also an extremely exciting transition period. The currency is gaining wide attention, and wider investment uptake. People are interested in not only Bitcoin, but also Ethereum, and "Bitcoin Cash" and other shitalt-coins pop up each day.
I want to offer a perspective, perhaps something like a Yield sign at the door before you start lining up your investment. Just stop and look. None of these things are some sort of "slam dunk" case against cryptocurrency, just something you need to know before you invest. Investing in cryptos could be something you still do, even if you believe everything below to be true (and it wouldn't be an irrational decision).
1) Cryptocurrency has a decentralized market place with no controls or checks and balances.
This means you get no support. Transactions are not reversible. Your mistakes are not recoverable. If you lose your password on an exchange your investment is gone. If you accidentally have your account hacked your investment is gone. If you regret or wish to change your mind on your purchase your Bitcoin is gone. You are fully responsible for securing this investment. There are a lot of options to secure and keep safe your investment in cryptocurrency, and you MUST take advantage of them.
There are a number of "best practices" with respect to keeping Bitcoin/cryptos as an investment. One of the hardest things to do with cryptocurrency is to stay up to date on the best practices without also considering cryptocurrencies as a hobby. You need to do this. It's not like a passive investment where you can "set it and forget it". Stay aware.
For example, it is best practice (I think?!) to keep your cryptocurrencies OUTSIDE of an exchange. Do not buy Bitcoin on an exchange and then keep your investment on that exchange. This is not intuitive compared to traditional investments, but it makes sense if you understand Bitcoin/cryptocurrencies, and some of the history with these big exchanges.
2) The marketplace is unregulated.
CIPF, IIROC, Securities Regulators, are only involved in the sense that they are "watching" what is going on with the cryptocurrency market. And certainly in the coming months they are going to be very antsy and concerned as they watch more and more of the general public get involved with these unregulated marketplaces.
All depository institutions and brokerages in Canada are supposed to be regulated. But what about QuadrigaCX, the exchange located in Vancouver that allows you to buy various cryptocurrency? Well, they aren't a financial institution, they state.
QuadrigaCX is NOT a financial institution, bank, credit union, trust, or deposit business. We DO NOT take Deposits. We exist solely for the purposes of buying and selling cryptocurrencies.
They actually don't let you deposit funds, and they don't let you use your "deposits" to buy cryptocurrency. They are actually the retailer of "QuadrigaCX Bucks", and then they use the "QuadrigaCX Bucks" to buy cryptocurrency which you can then do as you please. You do not have Canadian dollars on deposit at QuadrigaCX. You do not have the right to your "deposit". You only have the right to your "QuadrigaCX Bucks".
QuadrigaCX is not a bank, and therefore is not protected by CDIC. Fundings, whether they be in a national currency or digital cryptocurrency are not protected by any government insurance policy.
All account fundings are considered to be purchases of QuadrigaCX Bucks. These are units that are used for the purposes of purchasing Bitcoin or other cryptocurrencies. QuadrigaCX Bucks are NOT Canadian Dollars. Any notation of $, CAD, or USD refers to an equivalent unit in QuadrigaCX Bucks, which exist for the sole purpose of buying and selling Bitcoin and other cryptocurrencies.

You need to know what you are getting into here. You need to understand these kind of technicalities, and get a feeling for whether you can basically "blindly trust" these institutions. Of course, QuadrigaCX wouldn't be in business if they were screwing people over - but you need to know if you trust them, and if you can trust them with however much you deposit. You need to do your research, and stay in the loop.
Because at the end of the day, trust is all you have to rely on when you deal with some of these third-parties You almost certainly have no recourse if you get taken for a ride.
3) You need to be aware of the bias, and issues going on, in the communities that support cryptocurrency
There has been a lot going on with Bitcoin lately. The Foreign Miners have a weird stranglehold on the mining (maybe?), there was an attempt at a fork that was going on for ages and actually failed (maybe for the best? Maybe not?), there are huge accusations of vote manipulation and censorship in the Bitcoin subreddit, and the community itself can feel erratic, irrational, and at minimum pretty biased. You'll also find anyone who invests in some other coin might HATE Bitcoin, for little reason other than feeling like their choice is superior.
Honestly, I don't think a lot of these people are even trying to pump their investment. I think a lot of them are just BIG FANS and want to see the currency grow, for reasons that aren't selfish. They want to help you - but their enthusiasm is guaranteed, even if things aren't going well.
You need to be able to trust making your own decisions with respect to investing in any cryptocurrency. There are people who feel strongly about crytocurrency on both sides...and their opinions should not be trusted blindly.
From the perspective of regulators this would all be very unacceptable for the general public to be investing in and, to be frank, they are VERY valid concerns. For now while there are no regulated exchanges, no protections, and the community is not mature - my general warning is to put a lot of focus on protecting your new investment.
You are solely responsible for the safety and security of that investment. People might help you learn, but it is your responsibility in full to listen. Nobody has your back out there in the wild west that is cryptocurrency. If something goes wrong the community will likely offer nothing more than assistance not making the same mistake again.

OK, haven't seen a complete list of the ATMs of Vancouver and environs, with information on how intrusive the KYC is, or how high the fees are. Excuse the messy "formatting". The company filed a prospectus for a cash-settled Bitcoin futures fund — dubbed the NYDIG Bitcoin Strategy Fund — with the regulator on Wednesday, Oct 2. Based in New York City, Stone Ridge has some $15 billion in assets under management, serving clientele in both the United States and China. Founded in 2012, the firm offers portfolio management and advisory services.
Bithumb Looking To Build A Regulated Bitcoin Exchange In India Bithumb Global is looking to build a regulated Bitcoin exchange in India, the South Korea-based cryptocurrency exchange said. Bithumb Global will engage with Indian regulators to build the exchange, it said, even as the Supreme Court is hearing a case where Bitcoin operators have questioned a move by the Reserve Bank of India to restrict banking channels for virtual currency transactions. A government panel has also recommended a ban on cryptocurrency trade in the country. The company is looking to expand in India by partnering with local cryptocurrency exchanges, fund Indian cryptocurrency startups, and introduce new initiatives for Indian traders, said co-founder and managing director Javier Sim.
US State Of Ohio Suspends Service For Paying Taxes With Bitcoin Ohio Treasurer Robert Sprague announced the immediate suspension of the OhioCrypto.com website that allows businesses to pay taxes with Bitcoin (BTC). In an Oct. 2 press release, Sprague announced that according to an internal review, approval by the Board of Deposit was required before Ohio launched the website that allowed businesses to pay taxes with digital currencies. Furthermore, the State Board of Deposit has asked Attorney General Dave Yost to further research the legalities of how the crypto portal was set up and whether BitPay, the third-party processor that powered the service, constituted a “financial transaction device.”

For the first milestone, the Libra Association expects to bring on five partners deploying full nodes on the network. After bitcoin failed near the $8,500 resistance, there was a downside correction against the US Dollar. The BTC/USD traded below the $8,400 and $8,300 levels. Moreover, there was a break below the $8,200 level. However, the 100 hourly simple moving average acted as a support and a low was formed near $8,175. Recently, the price started a fresh increase and traded above the $8,300 level.
There was a break above the 50% Fib retracement level of the last decline from the $8,536 high to $8,175 low. The price climbed above the $8,350 level and tested the $8,400 resistance. It seems like the 61.8% Fib retracement level of the last decline from the $8,536 high to $8,175 low is currently acting as a resistance. If there is an upside break above $8,400, the price is likely to retest $8,500.
If the bulls manage to surpass the $8,500 barrier, there are chances of more upsides. The next stop for them could be near the $8,800 level. The next key resistance area is near the $9,000 level. On the downside, there is a decent support forming near the $8,250 and $8,200 levels. Moreover, there is a new connecting bullish trend line forming with support near $8,300 on the hourly chart of the BTC/USD pair.

After trading to a new monthly low at $7,670, bitcoin started an upside correction against the US Dollar. The BTC/USD pair broke the $8,000 resistance level to start the recent recovery. Moreover, there was a close above the $8,000 level and the 100 hourly simple moving average. As a result, the price climbed above the $8,150 and $8,200 resistance levels.
More importantly, yesterday’s highlighted major bearish trend line was breached with resistance near $8,080 on the hourly chart of the BTC/USD pair. The pair gained strength above $8,300 and surpassed $8,400. It even spiked above the $8,500 level and traded to a new weekly high at $8,525. At the moment, it seems like the price is facing resistance near the $8,500 level.
It might correct lower towards the $8,350 or $8,320 support. Moreover, the 23.6% Fib retracement level of the recent wave from the $7,670 low to $8,525 high is near $8,323 to provide support. If the price fails to stay above $8,300, it could correct lower towards the key $8,050 and $8,000 support levels. Besides, the 50% Fib retracement level of the recent wave from the $7,670 low to $8,525 high could provide support near $8,100.

Yesterday, there was a nice upside correction in bitcoin above the $8,200 resistance against the US Dollar. The BTC/USD even settled above $8,200 and the 100 hourly simple moving average. Moreover, the price surpassed the $8,400 resistance level. However, the bulls struggled near the key $8,500 resistance area. As a result, the price topped near the $8,540 level and recently started a downward move.
It broke the $8,400 support area, plus the 23.6% Fib retracement level of the last leg from the $7,653 low to $8,539 high. Moreover, there was a break below an ascending channel with support near $8,275 on the hourly chart of the BTC/USD pair. The pair tested the $8,200 support area and the 100 hourly simple moving average. If there are more downsides, the price could test the $8,100 support area.
Besides, the 50% Fib retracement level of the last leg from the $7,653 low to $8,539 high is also near the $8,100 level. Any further losses may perhaps drag the price towards the $8,000 handle. The 61.8% Fib retracement level of the last leg from the $7,653 low to $8,539 high is also near $7,992. If the price settles below $8,000, there could be additional losses towards the $7,500 support.

Recently, there was a minor upside correction in bitcoin above the $8,000 level against the US Dollar. The BTC/USD pair even climbed above the $8,200 resistance. Finally, the price spiked towards $8,400, but it failed to gain momentum. Moreover, there was no proper close above $8,200 and the 100 hourly simple moving average. As a result, the price started a fresh decline below the $8,000 support.
It even broke the $7,700 level and traded to a new monthly low at $7,661. Besides, the current price action is bearish, with an immediate resistance near the $7,900 level. Additionally, 50% Fib retracement level of the recent decline from the $8,157 high to $7,661 low is also near the $7,900 level. The main resistance on the upside is near the $8,000 and $8,100 levels. More importantly, there is a key bearish trend line forming with resistance near $8,050 on the hourly chart of the BTC/USD pair.
An intermediate resistance is near the $8,040 level, plus the 76.4% Fib retracement level of the recent decline from the $8,157 high to $7,661 low. Therefore, an upside break above the $8,000 and $8,100 levels is must for a decent recovery in bitcoin. The next key resistance is near the $8,400 level.

Unilever Says Its Blockchain Ad-Buying Pilot Saved The Company Money By 2% To 3% According to a report published on Sept. 26, executive vice-president for global media at Unilever Luis Di Como told advertisement news outlet Campaign that using blockchain has helped the company save money. BTC continued its downward trend from yesterday to today, dropping to around $7,800. BTC fell below $8,000 at one point in the morning, then rebounded quickly back above $8,000. Short-term market is still expected to be dominated by large-range shocks. If the $8,000 barrier is not held, it is possible to test support around $7,500 below. In terms of operation, the stage bottom still needs time to polish. It is suggested that the storage space should be controlled at about 50%.

Daimler Carries Out First Transaction On Marco Polo Blockchain Trade Network Automaker Daimler has carried out its first transaction on the blockchain-based Marco Polo trade finance network. The pilot commercial trade transaction saw the firm — which owns Mercedes-Benz among other brands — process the data required to exchange payments with engineering firm and parts builder Dürr, according to a press release sent to CoinDesk on Wednesday (Sept 25). German bank Landesbank Baden-Württemberg (LBBW) was also involved in the trade.
Monero Protocol Upgrade Is Scheduled On November 30 According to AMBCrypto, Monero has caught the attention of the crypto-community for its upgrade towards the end of the year. The protocol upgrade will be carried out to improve Monero’s existing offerings. This upgrade will include freezing of code, which means that no further changes can be done from the developers’ end. There will be a network upgrade too. In order to enjoy the latest features after the update, users will be required to upgrade their systems to CLI v0.15 or GUI v0.15. Along with these minor upgrades, there is a significant number of major changes. A tentative schedule for the proposed upgrade was decided to take effect on 30 November.
SEC Officials Would Consider To Creating Some Safe Harbour For Cryptos In a congress hearing on Sept 24 with SEC, a representative for North Carolina Patrick McHenry asked SEC chairman Clayton if he believes Libra is security. Clayton said that he was not prepared to make a decision. “We have to see how different assets function, to decide whether they would be a security, a commodity or a currency. But if what you are doing is using a digital asset to raise capital for a project with the idea that you are going to get a return as a result of investing in that project, sounds like security.” Mr.McHenry also expressed concerns that “too onerous regulation would drive off innovation from the US and the upside potential for investors.” SEC Commissioner Peirce thinks the SEC still has work to do to make sure that people can develop digital assets in the US in compliance with the SEC rules. “I would like to see us be a little bit more forward-thinking in ways that we might accommodate unique aspects of digital assets. For example, as digital assets that are utility tokens, I don’t know that the securities law framework that we have right now is an appropriate framework for them and so I’d like to see us think about creating some kind of a safe harbour,” said Peirce. Peirce stressed the idea is to allow is their current law for that SEC to write rigs around them and SEC has the authority that could allow the regulators to do that.

Yesterday, we saw a breakdown in bitcoin below the $10,000 support area against the US Dollar. The price remained in a bearish zone and broke many supports near $9,800 and $9,500. Moreover, there was a break below the $9,000 support and the 100 hourly simple moving average. Finally, the price traded close to the $8,000 level and registered a nasty decline. A low was formed near $8,055 and the price is currently correcting higher.
There was a break above the $8,250 and $8,400 levels. Moreover, the price traded above the 23.6% Fib retracement level of the recent decline from the $9,779 high to $8,055 low. However, the $8,750 level is acting as a strong resistance. The next resistance is near the $8,920 level. It coincides with the 50% Fib retracement level of the recent decline from the $9,779 high to $8,055 low.
If there is an upside break above $9,000, the price could recover towards the $9,400 and $9,500 resistance levels. Additionally, there is a crucial bearish trend line forming with resistance near $9,500 on the hourly chart of the BTC/USD pair. An intermediate resistance is near $9,120 and the 61.8% Fib retracement level of the recent decline from the $9,779 high to $8,055 low.
On the other hand, if the price continues to struggle near $8,750 and $9,000, it could resume its decline. An immediate support is near the $8,400 level, below which it could test $8,250. If the bears remain in action, there is a chances of a break below $8,000. The next major support is near the $7,500 level.
